Because the damage caps at a lower level, but the higher level is retained for the purpose of effects that go against raw caster level. Rather like how you can do a caster level 27 prot. fire.

EDIT: To clarify Ra's point.  You can still create essences, but the interesting part of cloning them and being able to transfer them no longer functions.   Undecided
