Bottom line:  Asheras can't be held accountable for wanting to buy crap at a significant sale.  We all want shit on discount.  It is wired into us.  When he was told straight up that the goods were contraband, he declined to go any further in the purchase process.  And so there is, in my mind at least, no clear judgement against him which can be made about his 'clean' play or not.
