It would be one of those situations where the court has to work out how to apply whatever law(s) are applicable to the uniqueness of the case.

Agreed. I don't consider dupes a breach of copyright either, especially considering it's done with their system. It's like saying Leonardo breaches his own copyright if he painted a second Mona Lisa exactly the same.
Ultimately the duping and dupe store are all glaring breaches of the ToS. But I'm in favour of them because SSG won't fix their shit.
